AOFAS reserves the right to cancel the Advanced Foot Course at any time.  In the event the Advanced Foot Course is entirely or partially canceled or postponed other than due to a Force Majeure, Attendee’s sole and exclusive remedy with respect to any damages, including incremental and consequential damages, sustained by Attendee as a result of such non-occurrence or postponement shall be a refund by AOFAS of registration fees paid by Attendee as of the date of such cancellation.

Attendee acknowledges and agrees that AOFAS’s performance under this Agreement is subject to and shall be excused due to one or more Force Majeure events (as defined herein) directly or indirectly impacting AOFAS or the Advanced Foot Course.  A Force Majeure is defined as a circumstance or occurrence beyond the parties’ control which makes it inadvisable, illegal, commercially impracticable, or impossible for the Advanced Foot Course to take place as planned, including, without limitation:  (i) acts of God, (ii) disasters (including, but not limited to, fire, flood, severe weather, and earthquake), (iii) war, (iv) civil disorder, (v) suspected or actual terrorism in or near the borders of the continental United States, (vi) government regulation (including, but not limited to, declared states of emergency), (vii) national or international public health authorities’ (including, without limitation, the Centers for Disease Control or the World Health Organization) declaration of public health emergencies, communicable disease, epidemic or pandemic advisories or alerts, (viii) strikes or work stoppages, (ix) curtailment of transportation services (including, without limitation, travel bans and advisories), (x) public or private policies which restrict or prohibit participants of the Advanced Foot Course from traveling to or attending the course.  AOFAS shall promptly provide notice (which may be sent via e-mail to the address on the registration form) of a cancellation due to the existence of one or more Force Majeure events, and Attendee agrees that AOFAS shall have no liability whatsoever to Attendee as a result of such cancellation or AOFAS’s partial or non-performance due to such Force Majeure.

Meeting sessions and educational displays are open to registered meeting attendees only. If you have applied but not received your registration confirmation within one (1) week of the first day of the Advanced Foot Course, please contact the AOFAS Education Department. Failure to confirm your registration may result in denial of entry due to capacity and registration restrictions. AOFAS is not responsible for any loss or damages, including incremental or consequential damages, arising out of an individual’s failure to ensure his or her registration is confirmed by AOFAS.

AOFAS may photograph or record any portion of the Advanced Foot Course in which you participate, in its sole discretion, and may use such recordings and photographs in the future for educational, promotional or marketing purposes. Without limiting the foregoing, all lecture and educational sessions will be recorded, including the question and answer portions of such programming, and may be used by AOFAS in the future for educational, promotional or marketing purposes. Photography during and recording of the sessions by anyone other than authorized AOFAS photography and audio visual personnel is strictly prohibited and may be grounds for expulsion.
